In 2006, article 151 of the Penal Code was amended penalizing incitement to discriminate and provides for liability for legal persons. The Penal Code provides for punishments for incitement of hatred, for violation of equality and for discrimination based on genetic risks. Measures have been enforced to restrain hate speech on Internet, including statements expressing discriminatory intolerance. In 2005, the rules to obtain Estonian citizenship were simplified.

Extracts from ECRI's third report (adopted in June 2005):
The number of stateless people who have obtained Estonian citizenship has been steadily increasing. In 2004 the powers of the Legal Chancellor was extended to allow it to examine cases of discrimination. However, there are still 139.000 stateless people in Estonia. Furthermore, Estonia has not adopted a comprehensive anti-discrimination law nor has it passed a law on the rights and the status of minorities. Moreover, some electronic media continue to publish antisemetic articles with almost complete impunity.
