The fight against all manifestations of racism, racial discrimination, xenophobia and related intolerance is at the core of the Italian Constitution and its judicial code, which are both focused on the principle of non discrimination and, more widely, on the protection of individuals. A Racial Anti-Discrimination Bureau (UNAR) has been established in the Prime Minister's Office. This Bureau has opened 351 discrimination files and in 218 of these cases objective discrimination has been found to have been suffered by the victim.

Extracts from ECRI's third report (adopted in December 2005):
Anti-discrimination legislation has been applied in some cases in the fields of employment and housing. However, the use of racist and xenophobic discourse in politics has intensified and targets in particular non-EU citizens, Roma, Sinti and Muslims. Members of Roma and Sinti communities continue to live in a situation of marginalization and practical segregation from the Italian society. Muslims also experienced deterioration in their situation. The vulnerability of the members of these groups to racism and discrimination has increased by the lack of political support for protection of individuals against incitement to racial violence and discrimination.
