FUNCTIONS & RULES OF PROCEDURE, etc.
I. Introduction
Soon after the collective deliberations in the Thematic Commissions (TCs) the Rapporteurs and the Rapporteurs from the panel discussions will carry with them their respective TCs/Plenary amendments and recommendations on the Draft Declaration and Programme of Action to the Drafting Committee in order to prepare the pre-final draft to be submitted later at the NGO Forum Plenary for approval and final adoption as the Final Declaration and Programme of Action.
II. Objectives of the Drafting Committee
- To achieve a draft Declaration and Programme of Action which can reach a worldwide consensus and solidarity in the struggle against racism among all groups affected by racism and intersectional intolerance and xenophobia.
- To consider for inclusion the input from TCs and panel discussions through their Rapporteurs so as to elaborate and edit the document which would be coherent and organic in content, approach, style, substance, language and mood and.
- To prepare the declaration and plan of action up to the stage that it can be presented to the plenary at the final day of the NGO Forum
- To present the pre-final document to the NGO Forum Full Plenary for its approval and adoption of the Final Declaration and Programme of Action
III. Composition of the Drafting Committee
- Membership:
- The Drafting Committee shall be comprised of a maximum of 8 persons:
- five regional representatives, one of them with indigenous background
- one representative from the international NGOs
- one youth representative
- one representative of the NGO Forum Secretariat
- Each of the TC Rapporteurs will have the status of resource persons for this TC. They will assist the Drafting Committee in preparing the pre-final draft.
- Each of the Rapporteurs of the four Plenary Sessions will have the status of resource persons for this Committee. They will assist the Drafting Committee in preparing the pre-final draft.
- The membership of the first three categories will form the Drafting Committee, which will be finally responsible for the elaboration of the pre-final draft Declaration and Programme of Action. Besides coordinating the Rapporteurs input to the draft documents, they would give the final touches, and submit the document to the International Steering Committee for its approval either by consensus vote or majority vote, before submitting it to the plenary session of the NGO Forum.
- The NGO International Steering Committee for WCAR (ISC) will monitor the overall process and progress of the Drafting Committee.
IV. Principles for Drafting
- International Human Rights and international standards will serve as the overall perspective for drafting of the Declaration and Programme of Action. In case language do not follow isn’t consistent with human rights standards the Drafting Committee may discuss alternative language.
- The principles of transparency, moral responsibility and accountability will guide the drafting work of the Drafting Committee members.
- Democratic norms will be strictly followed in the deliberation process.
- The Drafting Committee should hold a neutral position and should not carry forward any other interest than the one of the NGO community.
- The Drafting Committee has the liberty to edit the deliberations presented from the TCs without making substantial changes.
- No additions or changes shall be made after the delivery of the deliberations from the TCs to the Drafting Committee.
V. Mandate of the Drafting Committee members
- The Drafting Committee is the body responsible for the drafting process.
- Its members do not represent groups, NGOs or caucuses, but have the mandate to prepare a draft for the submission to the plenary session as technical persons.
- They should use their expertise to formulate the language suggestions of the different inputs into a workable language
- They are accountable to the ISC which in turn brings it back to the wider NGO community for final adoption.
- The Drafting Committee has power to take a collective decision to co-opt one or more members into the Drafting Committee, either on a part-time or full-time basis.
VI. Rules of Procedure for Drafting
- At its first session, the Drafting Committee will elect the Chair and the Secretary from among the Drafting Committee members by consensus or majority vote by a show of hands. In case of a tie, the election will be repeated. If there is one more tie, the Committee adopts secret balloting.
- The Rapporteur for each thematic text will present the amendments and recommendations of the respective TC in electronic format.
- No substantive alteration is to be introduced into the TC’s amendments and recommendations, however if such changes are essential, then the Drafting Committee shall consult the Rapporteur from the respective TC and as far as possible try to arrive to a consensus.
- In finalizing the draft document Drafting Committee can convene a meeting with the Rapporteurs and ISC if such a meeting is required.
VII. Preliminary tasks of the Drafting Committee before Durban
- Drafting Committee members need to initiate a discussion per e-mail on the methods of work they intent to employ in execution of their work and to inform the ISC accordingly.
- The Secretariat should facilitate the exchange of e-mail addresses of the members of the Drafting Committee.
- Drafting Committee members are required to meet in Durban at least 4 days before the NGO Forum to organize and co-ordinate the drafting process.
- The Drafting Committee members are required to identify, in advance, the sections of the draft documents that are relevant to each Thematic Commission and to provide the facilitator and rapporteur of each TC with this information and the at the briefing seminar on the 27th August.

- Seven small single rooms, if possible with adequate furniture
